New Bill: Child's Immunizations Must Be Analyzed in the case of Sudden Death (Florida SB 188)

• The bill would amend Florida Statutes § 406.11 to require that, in cases of an infant or child who dies suddenly and unexpectedly (including Sudden Infant Death Syndrome (SIDS), Sudden Unexpected Infant Death (SUID), or Sudden Death in the Young (SDY)), the autopsy must include microscopic and toxicology studies and a review of the child’s immunization and medical records.  

• It also covers sudden arrhythmic death syndrome (SADS) in individuals of any age, mandating similar autopsy review of immunizations when applicable.  

• The bill requires cases to be reported to the national SUID/SDY Case Registry per protocols of the Centers for Disease Control and Prevention (CDC) and the state’s Department of Health.  

• Penalties: For failure to report a qualifying case within 30 days after completion of the autopsy, a district medical examiner may face a fine of up to $1,000 for the first unreported case, up to $5,000 for the second. Further non-compliance can lead to referral for disciplinary action (suspension or removal).

• Effective date: July 1, 2026. The Florida Senate+1
